A DUNTOCHER man who was caught using a car while more than twice the legal drink-drive limit and with no insurance in place will now have to remain within his home at night for the next four months.

Martin Weldon, 29, who lives in Dunn Street in Clydebank, was appearing for sentence at Dumbarton Sheriff Court for the driving offences and for a further offence of shouting, swearing and making homophobic remarks.

Weldon had admitted his guilt to the offences, which took place in Luss Road, Alexandria on January 29 this year, during an earlier court appearance and sentence had then been deferred for background reports and a restriction of liberty assessment.

He was discovered in the Volkswagen Golf while under the influence of alcohol and when breath-tested, the sample he provided gave a reading of 52mcg of alcohol in 100ml of breath.

The legal limit is 22mcg. He also made the remarks which were aggravated by prejudice to sexual orientation.

When he appeared in the dock for sentencing, Sheriff William Gallacher said: “These are serious matters and you pose a risk to the rest of us because of your condition when driving.

“With some hesitation, I will impose a community payback order. I am also imposing a restriction of liberty order and you will remain within your home address between the hours of 7pm and 7am each night for the next four months.

“That’s to ensure that the rest of us are protected. You are at the limit with this offending and if it happens again, you will go to prison.”

The sheriff ordered that Weldon carry out 100 hours of unpaid work in the community within the next six months as a direct alternative to custody and disqualified him from holding or obtaining a driving licence for the next three years.
