A CLYDEBANK man who exposed himself and performed a sex act within sight of a woman on board a train has been put on the sex offenders register.

Derek Sweeney, 40, previously pleaded guilty to committing a sex act in a public place within sight of a female passenger during a journey between Hyndland and Yoker.

Fiscal depute David Gallagher told Dumbarton Sheriff Court that the incident happened on Monday, March 23, 2020 – the day of the national stay-at-home order.

The woman was travelling alone, and around 7.30pm, Sweeney boarded the train at Hyndland and chose a seat on the opposite side of the doors to her.

There was nobody else on board. She then saw him put his right hand down his trousers.

The woman started to feel she was being watched and looked up to see Sweeney staring at her and performing a sex act.

Mr Gallagher said: “She was in disbelief and made a point of not looking at him again. He alighted the service at Yoker and she reported the incident to the police.”

The entire incident was captured by on-board CCTV cameras.

When police found Sweeney, of Castle View, Clydebank, a month later, he told officers: “I don’t remember.”

Sheriff William Gallacher told the hearing on August 27 that he was “a little perplexed” that the case was being dealt with in Dumbarton as opposed to Glasgow, given the location of Sweeney’s offence. But he was told Dumbarton had been chosen as the appropriate court.

The sheriff deferred sentence until October 22 and added Sweeney to the sex offenders register in the interim.
