A DRUMCHAPEL man who kicked out at police officers in a domestic incident – while under a court order – has been jailed for six months.

Garry Rooney, 25, of Cloan Avenue, pleaded guilty at Dumbarton Sheriff Court last Friday to behaving in a threatening or abusive manner likely to cause a reasonable person to suffer fear and alarm. He was shouting and swearing and behaving in an aggressive manner.

He then struggled with police officers, kicking out at them. The incident happened on April 13 at a flat in Bruce Street, Clydebank.

Prosecutor Sarah Healing told the court police attended at 1.15am following a report of a disturbance.

She added: “Rooney was on the couch in the living room. He told police that this was his mother’s house and he was going nowhere. Officers warned him about his conduct and he told them to ‘f*** off and to get to f***’.

“He was apprehended and became aggressive. They attempted to handcuff him and he struggled violently and kicked out with his feet.

“He was placed on the ground and restrained. He continued to shout, swear and struggle.”

During a search at Clydebank police office Rooney was found to have cocaine worth £30.

Defence lawyer Phil McWilliams said: “It was a wholly unpleasant incident and there was no justification for his to behave in this way. He had been consuming both drink and drugs all day and has asked me to publicly apologise to the officers concerned.”

“He is no stranger to the courts for someone of his young age. He fully understands his position and that he faces jail, but a CPO would address his drug and alcohol issues. He had been making good progress and fell back into his addiction. He realises this cannot continue. His mother is anxious to have him return home.”

Sheriff John Hamilton also heard that Rooney was in possession of the class “A” drug, cocaine and at the time of both offences was on bail from Glasgow Sheriff Court, an order imposed on him on April 25, 2017.

Sheriff Hamilton said: “It is unacceptable behaviour and you were on a community payback order at the time as well, an order only imposed last September, and seven months into the order you are behaving like this.”

Rooney was jailed for six months and , reduced from eight months because of his early plea. The sheriff backdated the sentence to April 13, when he was first remanded in custody. He was admonished on the charge of being in possession of drugs.
