David Smith, of Lesmuir Drive, previously pleaded guilty to being in possession of a capsaicin canister at 4 Dunellan Drive, Clydebank. Last week the 25-year-old appeared at Dumbarton Sheriff Court for sentencing.

Carol Cameron, fiscal depute, told the court the dangerous spray was found in a garden by a neighbour on October 15, 2013.

Ms Cameron said: “Various items were found in the bag and one was the item on the charge.

“The person who found it contacted her brother-in-law. Police were in attendance a short time afterwards and took the bag.” The court heard the items underwent forensic testing and Smith’s DNA was found. Police attended at his home on January 28, 2014, detaining him. He was taken to Clydebank Police Office where he was cautioned and charged.

Mr Kavanagh, defending, told the court Smith — who appeared from custody on a separate matter — accepted a return to jail was inevitable.

Sheriff Craig Turnbull sentenced Smith to three months in prison.
