AN OLD Kilpatrick man who spat on his partner’s head in an assault at a pub has been spared a prison sentence.

Instead, Thistleneuk resident David Gordon will have to carry out unpaid work in the community as a punishment after he attacked the woman at the Stag’s Head in Glasgow Road, Dumbarton, on January 24.

Gordon, 51, appeared before Sheriff Maxwell Hendry at Dumbarton Sheriff Court on Friday, when his solicitor said Gordon had been released from a prison sentence on an unrelated matter on November 17.

He is also subject to a special bail condition preventing him from contacting or approaching the woman – and lawyer Brian McGuire said his client was complying with that, even though he has been repeatedly contacted by his former partner.

Mr McGuire said: “He’s been bombarded with correspondence from her and he’s ignoring that.

“He takes the view the relationship is at an end and has taken advice on how he should go about ensuring there’s no further difficulty.”

Sheriff Hendry handed Gordon a community payback order to carry out 150 hours of unpaid community work within nine months and be under social work supervision until May 2019.

Gordon also admitted breaching a bail condition by failing to answer the door to police on February 15 during the hours of a curfew. A review hearing will take place on February 9 along with sentencing for the bail breach.
