A MAN charged with attempting to rob a shopkeeper in Clydebank – while being in possession of two knives – has been declared unfit to stand trial.

Kamil Fortuna, 21, whose address in court was given as prisoner of Polmont Brightons, was not in court when the case returned to Dumbarton Sheriff Court on Tuesday, June 13.

Mr Fortuna is still on remand.

It’s alleged that on Friday, March 10, 2016, at Day Today, in Radnor Street, Mr Fortuna tried to rob a shopkeeper while masked, present two knives at him, demand money and attempt to rob said shopkeeper of a quantity of money.

It’s also alleged Mr Fortuna committed the offence while on bail, twice, from Glasgow Justice of the Peace Court, back on September 4, 2015.

It is further alleged that Mr Fortuna, on December 20, 2016, having been charged with attempted robbery, he failed to appear for a diet in respect of solemn proceedings at Dumbarton Sheriff Court without reasonable excuse.

Mr Fortuna is maintaining his plea of not guilty to the charges, through his solicitor.

When the case returned to court there was a joint motion from the Crown and defence to continue the matter until a later date so an examination of the facts could be debated.

Sheriff Maxwell Hendry imposed a temporary compulsion order, meaning that Mr Fortuna must stay in hospital for treatment.

He added: “I am finding him (Mr Fortuna) unfit for trial by reason of his mental condition.”

The order will remain in place until the conclusion of the examination of the facts, which will take place at Dumbarton Sheriff Court on Wednesday, June 28.
