A CLYDEBANK man came “perilously close” to being jailed after he behaved in a threatening or abusive manner.

Gary Gallagher, 31, of Kilbowie Court, appeared in Dumbarton Sheriff Court on Friday for sentencing.

Fiscal Emma Thomson told the court that on May 14, 2017, in Duntocher Road, the accused and his partner were arguing in their bedroom. Neighbours could hear both parties repeatedly tell each other to "f*** off". This continued for some time.

Police attended the property and Gallagher was detained under section 38. On May 14 he was cautioned and charged and made no comment.

Gallaghers defence solicitor Lauren Kerr said: “He accepts that he shouldn’t have been shouting and swearing that early in the morning or to his partner.

"He is making good progress and has completed his hours of unpaid work. I realise that is what they are meant to do but he has completed them.

“He is keen to have the matters resolved. He wants these matters dealt with so he can get back into work.”

Sheriff Simon Pender, said: “You are coming perilously close to a custody outcome but I have been persuaded into dealing with you by means other than a custodial sentence. If you fail to comply you will be brought back to court.”

Gallagher was given 160 hours unpaid work to be completed in eight months.
