A YOKER man has been sentenced to a two-year drug treatment and testing order (DTTO) after being caught with heroin at Clydebank Police Office earlier this year.

David Cobain, 32, who did live in Hartree Avenue at the time of the offending but has now moved to Kingsway Court, was appearing at Dumbarton Sheriff Court in relation to two offences. The other was a drink-driving offence which took place on November 29 last year.

On that occasion Cobain was discovered driving a Volkswagen Polo in Cornock Street while more than twice the legal drink-drive alcohol limit. When breath tested, the sample he provided gave a reading of 50mcg of alcohol in 100 ml of breath, more than twice the legal limit of 22mcg.

Judith Reid, defence solicitor for Cobain, told Sheriff Maxwell Hendry that her client was prescribed a high dosage of the heroin substitute methadone, and that he had family and relationship difficulties due to his drug use.

Placing Cobain on the DTTO for the drug charge, Sheriff Hendry told him: “At the moment there is no punishment being imposed by this court but don’t be under any illusions – there will be further down the line in respect of the driving matter.

“You are getting an opportunity in respect of the drug matter. It won’t just go away [drug problem] and you will possibly have to deal with it for the rest of your life.The best thing you can do is give it 100 per cent. not just 75 or 80 per cent. If you can do that for two years then there will be a substantial change in your life.” but it’s not easy to do all that is required.”

The sheriff deferred sentence on the drink-driving matter until November 20 and called for a supplementary criminal justice social work report to be prepared. He also ordered Cobain to remain of good behaviour until then and confirmed that an interim disqualification from holding or obtaining a driving licence would remain in place.
