ASBO man terrorised his neighbours

A ROWDY man breached his ASBO three times by terrorising his neighbours.

Andrew Hendry tormented residents in his steet by screaming in his flat and banging loudly at all times of the night — contravening his Anti Social Behaviour Order.

The first incident flared at 1.15am on September 30 last year when neighbours could hear loud banging, Dumbarton Sheriff Court heard.

Hendry was spotted kicking rubbish around the third floor of his block of flats and police were called.

On November 11, police were summoned again after neighbours heard banging and screaming coming from the apartment.

Jeanette McLean, fiscal depute, said although police attended, the noise had stopped and Hendry was not answering his door.

The final problems were on January 31 this year at 9.30pm when again neighbours heard banging coming from the 30-year-old’s flat.

Ms McLean added: “Police attended and could hear banging and screaming.

“They forced their way into the flat and the only person within was the accused who was arrested for breaching his ASBO.” Hendry, of 3b Cleddans View, Clydebank, admitted three breaches of the ASBO, which was imposed in August 2007.

His lawyer, Roddy Boag, said: “There has been co-operation from the accused with dealing with these matters which he has spent a month in custody for.

“He knows he cannot continue to reside at his home address and is clear he does not want to find himself in custody again.

“He would benefit from a probation order which would help with his issues and this also includes victim awareness.”

But Sheriff Robert Vaughan disagreed that probation was the best option and jailed Hendry for a total of seven months.

He said: “You have a fairly lengthy record and the nature of these offences together with this offence confirms that a custodial sentence is appropriate.

“You have breached an Anti Social Behaviour Order on three occasions causing chaos for your neighbours and stopping them from sleeping.”
